LOS ANGELES, CA -- A 10-year-old Florida boy was hospitalized after suffering a serious head injury when his bicycle collided with a motor vehicle earlier this week, according to a report from the local NBC affiliate. The boy was reportedly riding his bike around 4:45 p.m. on Monday when he was hit by a motorist near the 1600 block of SE 29th Terrace in Cape Coral. Noted bicycle injury lawyer Jeff Nadrich recently commented on the case.
“As a parent, I am gravely impacted by stories like this,” said Nadrich. “So far, authorities have released few details, and it is too early to state definitively how the accident happened or whether the motorist bears legal responsibility, but based on the circumstances, one cannot help but wonder what might have been done to prevent this. There are always extenuating circumstances, but when these types of collisions occur, the liability most commonly falls on the shoulders of the automobile driver. We will need to await further details before we can make such a determination about this particular case.”
Nadrich further notes that helmet use may play a role in this case. “The reports are indicating that the young boy was not wearing a helmet, which is truly tragic. In Florida, all riders under the age of 16 are legally required to wear a helmet, in the hopes of preventing this very type of incident. I would urge all riders, regardless of age of jurisdiction, to wear a helmet at all times, as they really do save lives.”
According to the NBC report, the young boy was taken to a Tampa hospital and was found to have several skull fractures. At the scene of the accident, he was reportedly alert and oriented, and claimed only to have minor head pain.
